Notice of a Public Hearing

Development Permit and Temporary Use Permit Standardization Project

Pursuant to Sections 464, 465 and 466 of the Local Government Act notice is hereby given that a public hearing will be held on Tuesday, October 23, 2018, 6:00 pm at the Regional District of Nanaimo Board Room, 6300 Hammond Bay Road, Nanaimo regarding the following proposed:

What are the proposed bylaws about?

The proposed bylaws amend 25 development permit areas (DPAs) that currently apply to individual official community plan (OCP) areas to create seven standard DPAs. They also move the ‘applicability’, ‘exemption’ and ‘guideline’ sections of all DPAs from the OCPs to the zoning bylaws, except for those in the Schooner Cove and Lakes District Neighbourhood Plans which are not included in this project. Relocating these sections of the DPAs into the zoning bylaws will streamline ease of use, and allow for more effective enforcement. Designation of DPAs and description of the special conditions or objectives that justify the designations remain in the individual OCPs. There are also updates to text and maps to facilitate standardization and best practices.

For temporary use permit (TUP) areas, the proposed bylaws move all regulations and requirements to the zoning bylaws for the purpose of standardization, and to make them easier to interpret. Except where restrictions on temporary uses related to resource processing are already in place, these bylaws allow the Regional District of Nanaimo to issue a TUP for any use on any parcel not permitted by the zoning bylaw, based on a list of conditions to determine the suitability of the temporary use. For Zoning Bylaw 1285 that only applies to Electoral Area F, a shorter version of the TUP section in Bylaw 500 is used as regulations related to specific uses do not apply to Area F.

Where can I inspect the documents?

A copy of the proposed bylaw and relevant documents may be inspected at the hearing or prior to the hearing at the Regional District of Nanaimo (RDN) Administration office located at 6300 Hammond Bay Road, Nanaimo, Monday to Friday (excluding public holidays) 8:30 am to 4:30 pm, with extended business hours until 5:30 pm on Wednesdays. The public hearing for this bylaw will be chaired by Director Stanhope or the deputy chair of the Electoral Area Services Committee as a delegate of the Board.

All persons who consider their interest in their property to be affected by the proposed bylaw shall be afforded an opportunity to be heard in person or by written submission at the public hearing. Written submissions can also be submitted in advance of the public hearing and must be received at the RDN office by 4:00 pm, Tuesday, October 23, 2018 to ensure their inclusion in the public record.
